1. About this policy

1.1This policy explains how Stephen Alexander Manning trading as SMFP, ABN 59 407 037 823 (SMFP, we, us, our) handles personal information through the SMFP website at smfp.au and its calculators, articles, AI product explainer and other services (the Services).

1.2SMFP complies with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

1.3Words defined in our Terms and Conditions (such as Explainer, Inputs and Outputs) have the same meaning here.

2. What we collect

2.1Account and subscription details: your email address, subscription status and renewal dates, and the login link details we use to sign you in. We do not receive or store your card details.

2.2What you ask the Explainer: the product names you search for, links you give it, and the documents it uses (see clause 5).

2.3Usage and technical information: pages viewed, features used, browser and device type, the referring site, and daily usage counts used to apply fair-use limits.

2.4Messages you send us: anything you tell us when you contact us.

2.5Calculator figures: calculators run entirely in your browser. The figures you enter are not sent to or kept by SMFP.

3. How we collect it

3.1We collect information directly from you when you subscribe, log in, use the Services or contact us.

3.2We collect technical and usage information automatically, including through cookies, browser storage and analytics tools (see clause 9).

3.3When you buy a subscription, our payment provider tells us the payment has been made so we can give you access.

4. How we use it

4.1We use personal information to:

4.2With your consent, or where the law otherwise permits, we may also send you news about SMFP. Every marketing email has an unsubscribe link.

4.3We do not sell personal information.

4.4We do not use your Inputs or Outputs to train or fine-tune any AI model, and we only use AI providers whose terms do not permit them to train their models on data submitted through SMFP.

5. The AI product explainer

5.1When you use the Explainer, the product name you enter, or the link or document you provide, is sent to our AI provider, which finds and reads the product disclosure statement and prepares a summary.

5.2We keep a record of Explainer requests, including the product searched for, the documents used and the outcome, to check the Explainer is working as designed, improve its safeguards and comply with the law. These records are kept for up to 90 days.

5.3If you upload a document, we use it only to create the summary and do not keep it. Please upload only a PDS or similar document published by the product issuer. Do not upload statements, letters or other documents containing personal information. If a document is not a PDS, the Explainer rejects it and no summary is kept.

5.4We keep summaries of PDSs, which contain no personal information, and may show the same summary to other users who ask about the same document.

5.5The Explainer does not make decisions about you. It summarises what a product’s disclosure document says.

6. Who we share it with

6.1We use these service providers to run the Services. They receive only the information they need for their role.

6.2We may disclose information where the law requires or allows it, such as to regulators or law enforcement, or to professional advisers bound by confidentiality.

7. Overseas disclosure

7.1SMFP’s website and systems are hosted in the United States (Amazon Web Services, US East, North Virginia). AI processing for the Explainer also takes place in the United States. Some providers listed in clause 6.1 may also process information in other countries.

7.2We take reasonable steps, including through our contracts with service providers, to ensure overseas providers handle personal information consistently with the APPs.

8. Security and retention

8.1We protect personal information with measures that include encryption in transit and at rest, access controls and logging.

8.2If a data breach is likely to result in serious harm, we will act under the Notifiable Data Breaches scheme.

8.3We keep account information while your account is active and for as long as needed afterwards for tax, accounting and legal purposes. Daily usage counts are deleted within 2 days. Explainer request records are deleted within 90 days.

9. Cookies, browser storage and analytics

9.1SMFP uses cookies, browser storage and similar technologies to keep you signed in, remember your settings, understand how the site is used and keep it secure.

9.2We use Google Analytics to understand, in aggregate, how the site is used.

9.3You can block or delete cookies and site data in your browser settings. If you do, you may need to sign in again and some features may not work.

10. Advisers using SMFP

10.1If you are a financial adviser and enter information about a client, the Terms (Schedule A) apply. You must be entitled to disclose it to SMFP, and SMFP handles it only to provide the Services to you.

11. Access and correction

11.1You can ask for access to the personal information we hold about you, or ask us to correct it. We will respond within 30 days. We do not charge you to make a request.

11.2If we refuse a request, we will tell you why and how to complain.

12. Questions and complaints

12.1Contact us at contact@smfp.au with any question or complaint about privacy. We will acknowledge a complaint promptly and aim to respond within 30 days.

12.2If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992.

13. Changes to this policy

13.1We may update this policy. We will tell subscribers of any material change by email or in the Services, and the date at the top will show when it last changed.
